该职位主要负责以下事务:
- 海外专利诉讼策略制定及执行;
- 全球专利诉讼热点案件的发展趋势跟踪和分析,尤其是涉及SEP或NPE的政策及司法动态研究;
- 为支持海外知识产权诉讼选聘不同境外司法辖区的外部律师团队;
- 协调和跟进境外司法辖区内的不同外部律师团队;
- 牵头推进境外/跨境知识产权争议解决案件(包括维权及应诉)
- 为公司进入海外市场做好应对当地知识产权纠纷的准备
This position is primarily responsible for the following tasks:
- Formulating and implementing strategies for overseas patent litigation;
- Monitoring the development and trends of patent litigation cases globally, especially regulations/policies and judicial developments with respect to SEP (Standard-Essential Patent) or NPE (Non-Practicing Entity) practice;
- Managing and supporting the retention of external counsels in foreign jurisdictions as required for overseas IP litigation.
- Coordinating and liaising with external counsels in different foreign jurisdictions;
- Leading overseas/cross-border contentious IP cases for both defensive and offensive matters;
- Preparing for handling IP disputes when entering overseas markets.
职位要求
- 具有机械、汽车工程、计算机、通信和/或电气工程专业的本科学位或同等学历并持有中国或其他相关境外司法辖区专利代理师资格证书和律师执业资格证;
- 具有至少8年的知识产权诉讼从业经验,具有5年以上境外专利诉讼经验;
- 具有知名国际律所或跨国科技公司的工作经验优先;
- 具有丰富的境外专利诉讼实战经验,具备在欧洲或美国的NPE/SEP谈判/诉讼经验者优先;
- 熟悉欧洲相关法律者优先; - 中英文流利,德语流利者优先;
- 优秀的商业意识及较强的沟通、分析、规划和谈判能力;
- 具有团队搭建和管理能力;
- 出差比例:10% - 20%。
- Bachelor’s degree or above in mechanical engineering, automotive engineering, computer science, telecommunication and/or electrical engineering, with qualifications as a patent attorney as well as a licensed lawyer in China or other relevant foreign jurisdictions;
- At least 8 years of experience in the field of IP litigation, with over 5 years of experience in overseas patent litigation;
- Work experience in top tier international law firms or major multinational tech companies is highly preferred;
- Extensive experience in handling cross-border patent litigation is required, relevant experience in NPE/SEP negotiation/litigation before European or US courts is highly preferred;
- Familiarity with European laws is preferred; - Fluency in both Chinese and English is required; fluency in German is a plus;
- Strong business acumen and communication, analytical, organization, and negotiation skills; - Ability to build up and manage an in-house team;
- Travel requirement: 10% - 20%.
